Eligibility relates to whether the person is a refugee, and admissibility to criminality or other bars. 1. How is a refugee eligible? 2. How is a refugee admissible? 3. When do refugees have a durable solution? Refugees will not be accepted if they have access to a durable solution. This comes up most often if the immigration officer considers that the person could integrate locally. A durable solution might be available if a person has access to permanent status through a refugee claim process, or as a result of marrying someone of a different nationality. In general, the Canadian government tends to consider refugees to have a durable solution if they are in a country that has signed the Refugee Convention, has a refugee claim process and offers permanent status. Some exceptions may apply. The availability of a durable solution is often controversial as refugees may feel they are unsafe, for example due to widespread and violent racism, in countries where they have refugee status.
